8. AI-Specific Terms & Disclaimers
Our services involve artificial intelligence technologies that may produce automated outputs.
You acknowledge and agree that:
AI outputs may be inaccurate, incomplete, or unsuitable for specific purposes
AI outputs are provided “as-is” without guarantees of accuracy, reliability, or uniqueness
You are responsible for reviewing, validating, and approving all AI-generated outputs before use
We are not responsible for business, legal, financial, or operational decisions made based on AI outputs
Third-party AI providers (such as OpenAI) may process data in accordance with their own terms and policies.
9. Intellectual Property
a. Our Intellectual Property
All systems, software, workflows, prompts, methodologies, designs, and infrastructure developed by us remain the exclusive property of Blue Gum Automation unless otherwise agreed in writing.
b. Client Intellectual Property
You retain ownership of your data, content, and materials provided to us
You retain ownership of AI outputs generated specifically for your business
You grant us a limited licence to use your content solely for the purpose of providing the services
AI outputs may not be unique and may be similar to outputs generated for other clients.

Our services rely on third-party platforms, including but not limited to:

Stripe
Calendly
We are not responsible for outages, errors, or changes caused by third-party services.
11. Suspension and Termination
a. Termination by Either Party
Either party may terminate the services with reasonable notice.
b. Immediate Termination
We may immediately suspend or terminate services if you:
Breach these Terms
Fail to pay fees when due
Use the services unlawfully or abusively
c. Survival
Clauses relating to intellectual property, payment obligations, liability limitations, and dispute resolution survive termination.
12. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, special, or consequential losses
Our total liability is limited to the fees paid by you in the 12 months preceding the claim
Nothing in these Terms excludes liability that cannot be excluded under Australian law.
13. Indemnity

If still unresolved, the dispute may be brought before the courts of Victoria
